Terms of Service

These Terms of Service ("Terms") govern your access to and use of BikepackPro (the "App," "we," "us," or "our"), including its community features. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

Our Privacy Policy explains how we handle your information and is incorporated by reference.

1) Overview

BikepackPro is a bikepacking utility app available on the Apple App Store that provides route visualization, ride metrics, weather information, and community features. The App uses Apple frameworks (e.g., Location Services, iCloud/CloudKit, StoreKit), trusted third-party providers for maps and weather, and our own servers for community functionality such as shared points of interest (POIs) and routes.

2) Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. If you are under the age of majority in your jurisdiction, you may only use the App with the consent of a parent or legal guardian who agrees to these Terms.

To create a community account and submit public content, you must be at least 16 years old (or the age of digital consent in your jurisdiction, if higher). If you are between 13 and the applicable age of digital consent, you may view community content but may not create a community account without verifiable parental or guardian consent.

3) Your Account

  • Apple ID: Certain features require an Apple ID (e.g., iCloud sync, subscriptions). You are responsible for maintaining the security of your device and Apple ID.
  • Community Account: To access community features (submitting POIs, routes, and other content), you must create a community account. You are responsible for all activity that occurs under your account and for keeping your login credentials secure.
  • Display Name & Avatar: You may set a display name and avatar for your community profile. Your display name and avatar are publicly visible to all users. You agree that your display name and avatar will not:
    • Impersonate any person, brand, or organization;
    • Contain offensive, vulgar, or discriminatory language or imagery;
    • Infringe any third party's intellectual property or rights;
    • Include personally identifiable information of another person.
    We reserve the right to modify or reset any display name or avatar that violates these rules, at our sole discretion.
  • Accuracy: You agree that any information you provide is accurate and up to date.
  • Backups: You are responsible for backing up your data. We recommend enabling iCloud backups where available.
  • Account Deletion: You may delete your community account at any time. See Section 7 for details on how deletion affects your community submissions.

4) Subscriptions & Billing

  • StoreKit: Subscriptions and in-app purchases are processed by Apple via StoreKit. We do not collect or store your payment card information.
  • Billing & Renewal: Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Manage or cancel in Settings → Your Name → Subscriptions on your device.
  • Trials: If offered, free trials convert to paid subscriptions unless canceled before the trial ends.
  • Refunds: Any refunds are handled by Apple in accordance with App Store policies.
  • Entitlements: Your purchase unlocks an entitlement for features while your subscription is active. We may verify entitlements using App Store receipts.

5) Acceptable Use

You agree not to, and not to permit others to:

  • Use the App for any unlawful purpose or in violation of applicable laws or regulations;
  • Interfere with or disrupt the App or its servers, including by introducing malware or excessive traffic;
  • Reverse engineer, decompile, or attempt to derive the source code of the App except as permitted by law;
  • Use the App in a manner that infringes third-party rights or violates these Terms;
  • Scrape, index, or harvest data from the App except as permitted by its intended use;
  • Submit false, misleading, or intentionally inaccurate community content (e.g., fake POI locations, fabricated route descriptions, or misleading safety information);
  • Submit community content that could endanger the health or safety of others (e.g., falsely marking a location as a safe water source, or routing through prohibited or dangerous areas);
  • Harass, bully, threaten, or intimidate other users through community features;
  • Post content that is obscene, defamatory, discriminatory, or promotes hate or violence;
  • Upload photos or content depicting illegal activity, explicit material, or minors without parental consent;
  • Post personally identifiable information of any other person without their consent;
  • Use community features for advertising, solicitation, or commercial promotion without our prior written consent;
  • Create multiple accounts to circumvent suspensions, bans, or content removals.

6) User Content

  • Your Content: You may create or store routes, notes, or other content ("User Content"). You retain ownership of your User Content.
  • Private Content License: For content stored privately on your device or in your personal iCloud (not submitted to community features), you grant us a limited, non-exclusive, worldwide, royalty-free license to process your User Content solely to provide App functionality (e.g., display, sync, and device storage). Where content is stored in your private iCloud, we do not have access to it.
  • Community Content License: When you submit content through community features (including POIs, routes, descriptions, names, and photos), you grant us a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, display, distribute, and make available your submitted content to other users of the App and related services. This license is necessary so that we can show your submissions to the BikepackPro community. This license continues even if you delete your account, to the extent that your content has already been distributed (see Section 7 for details).
  • Representations: By submitting community content, you represent and warrant that:
    • You own or have the necessary rights and permissions to submit the content;
    • Your content does not infringe, misappropriate, or violate any third party's intellectual property, privacy, or other rights;
    • Any photos you upload were taken by you or you have the right to share them;
    • Your content is accurate to the best of your knowledge and not intentionally misleading.
  • Responsibility: You are solely responsible for your User Content and any consequences of submitting or publishing it.

7) Community Features & Guidelines

a) Public Submissions

Community features allow you to submit points of interest (POIs) and routes, including names, descriptions, and photos. All community submissions are public by default and visible to all users of the App. By submitting content to community features, you acknowledge and agree that your content will be viewable by other users along with your display name.

b) Content Standards

All community submissions must:

  • Be relevant to bikepacking, cycling, or outdoor recreation;
  • Be accurate and truthful to the best of your knowledge;
  • Comply with the Acceptable Use rules in Section 5;
  • Not contain embedded links, advertisements, or promotional material.

c) Photo Guidelines

Photos submitted through community features must:

  • Be photos you have taken yourself or have explicit permission to share;
  • Not contain explicit, obscene, or violent imagery;
  • Not depict identifiable individuals without their consent;
  • Not contain copyrighted material belonging to others (e.g., screenshots of other apps, published maps).

d) Moderation

We reserve the right, but are not obligated, to review, edit, or remove any community content at our sole discretion and without notice, for any reason, including content that we believe violates these Terms or may be harmful, inaccurate, or objectionable. We are not responsible for any failure to remove content or any delay in doing so.

e) Reporting

If you believe that any community content violates these Terms, is inaccurate, or is otherwise objectionable, you may report it through the in-app reporting feature or by contacting us at support@bikepackpro.app. We will review reports and take action as we deem appropriate.

f) Copyright Claims

If you believe that community content infringes your copyright, please send a notice to support@bikepackpro.app that includes:

  • A description of the copyrighted work you claim has been infringed;
  • A description of the infringing content and its location within the App;
  • Your contact information;
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner;
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

g) Enforcement

Violations of community guidelines may result in escalating enforcement actions, including but not limited to:

  • A warning;
  • Removal of specific content;
  • Temporary suspension of community privileges;
  • Permanent ban from community features;
  • Termination of your account.

We may take any enforcement action we deem appropriate in our sole discretion, including skipping to more severe actions for serious violations. Enforcement of community privileges is separate from access to non-community App features (e.g., route viewing, weather), which may remain accessible.

h) Account Deletion & Content Retention

If you delete your community account:

  • Your profile (display name and avatar) will be removed;
  • Community submissions you have made (POIs, routes, descriptions, and photos) may be retained in an anonymized form to preserve the integrity of the community database for other users;
  • If you wish to have your community submissions fully deleted, you may request this by contacting us at support@bikepackpro.app prior to or after deleting your account. We will process such requests within a reasonable timeframe.

i) No Guarantee of Accuracy

Community content is submitted by users and has not been independently verified by BikepackPro. We make no representations or warranties about the accuracy, completeness, reliability, or safety of any community-submitted content. You use community content at your own risk. Always verify critical information (water sources, trail conditions, road closures, etc.) through independent sources before relying on it.

8) Location Services

The App uses location data to provide core features. Accuracy may vary and depends on device sensors, connectivity, and environmental conditions. You can disable location permissions in system settings, though some features may not function without them.

9) Third-Party Services

We integrate third-party services to deliver maps and weather:

These providers may process device/network information and location as needed to deliver their services. Your use of their services is subject to their terms and policies.

Community features are powered by BikepackPro's own servers. Community data (your account information and submissions) is processed and stored on our servers, separate from iCloud/CloudKit. See our Privacy Policy for details on how this data is handled.

10) Safety Notice (Important)

  • No emergency service: The App is not a substitute for emergency services.
  • Outdoor risks: Cycling and outdoor travel involve inherent risks. Use your judgment and obey local laws, signage, and traffic rules.
  • Do not rely solely on the App: Always carry appropriate equipment, maps, and safety gear. Conditions can change rapidly.
  • Community content: Points of interest, routes, and other content submitted by community members are user-generated and have not been verified by BikepackPro. Do not rely solely on community-submitted information for safety-critical decisions such as water source availability, trail conditions, or route accessibility. Always verify critical information independently.

11) Ownership & License

  • Our Rights: The App (including software, design, logos, and content) is owned by us or our licensors and is protected by intellectual property laws.
  • Your License: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, per the Apple Media Services and App Store terms.
  • Reservation: We reserve all rights not expressly granted.

12) Feedback

If you provide ideas, suggestions, or feedback, you grant us a perpetual, worldwide, irrevocable, royalty-free license to use them without obligation or compensation, including to improve the App.

13) Changes to the Service

We may modify, suspend, or discontinue features of the App at any time, including for maintenance, security, legal, or business reasons. Where feasible, we will provide notice of material changes. This includes changes to community features, and we reserve the right to modify or discontinue community functionality at any time.

14) Termination

You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms or if required by law. Upon termination, your license ends and you must cease use of the App. Termination does not affect any rights or obligations accrued up to that date.

Community-specific termination: We may suspend or terminate your community account and privileges independently from your access to non-community App features. For example, a violation of community guidelines may result in loss of your ability to submit or interact with community content while you retain access to other features such as route viewing and weather. In the event of community account termination by us:

  • Your community profile (display name and avatar) may be removed or anonymized;
  • Your community submissions may be retained, removed, or anonymized at our discretion;
  • You may not create a new community account to circumvent the termination.

15) Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT RESULTS WILL BE ACCURATE OR RELIABLE.

WE DO NOT ENDORSE, VERIFY, OR GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY COMMUNITY-SUBMITTED CONTENT, INCLUDING POINTS OF INTEREST, ROUTES, DESCRIPTIONS, OR PHOTOS. COMMUNITY CONTENT IS PROVIDED BY USERS AND DOES NOT REPRESENT THE VIEWS OR RECOMMENDATIONS OF BIKEPACKPRO.

16) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, INCLUDING ANY RELIANCE ON COMMUNITY-SUBMITTED CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE APP OR SUBSCRIPTION IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED CANADIAN DOLLARS (CAD $100), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; THESE LIMITATIONS MAY NOT APPLY TO YOU.

17) Indemnification

You agree to indemnify and hold harmless BikepackPro and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the App, your User Content (including community submissions), your violation of these Terms or applicable law, or any claim by a third party relating to content you submitted through community features.

18) Governing Law; Venue

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles. You agree to the exclusive jurisdiction and venue of the courts located in Toronto, Ontario, Canada, for all disputes arising out of or relating to these Terms or the App.

If you are a consumer and your local mandatory laws provide you with additional protections, those protections remain in force.
